In a shameful and deeply unjust decision, the Supreme Court has chosen to uphold the Trump administration’s anti-trans passport ban—a policy that strips transgender, nonbinary, and intersex individuals of the right to update their gender markers or access an X marker. Under this ruling, markers must now align with one’s sex assigned at birth. This order was previously stayed by a temporary injunction in January that halted its enforcement.

The reinstatement of Trump’s policy carries devastating, real-world consequences for our community.

To take away the right to self-identification is an act of discrimination. It is discriminatory in its attempt to erase trans people from public life and restrict their ability to move freely and safely. It is discriminatory in its effort to dehumanize trans people and deny them the rights that belong to them. And it is discriminatory in the way it endangers lives through forced outings, harassment, and violence.

Let us be clear: this is not governance—it is targeted cruelty disguised as policy. This is yet another calculated move by the Trump administration to treat trans lives as political chess pieces, wielding fear and hate to push our community further into the shadows. They are playing with real people’s lives, and this decision makes everyday life harder for an already marginalized community. 

It’s unconstitutional. It’s unjustified. And it blatantly disregards the promise of equal rights.

But we refuse to be silenced. And we refuse to give up.

The ACLU continues to fight for a reversal of this decision to protect the right to accurate identification for all. Their work—and ours—will not stop until the rights and dignity of our community are fully protected.

At this time, it remains unclear how the current process for updating gender markers or applying for passports will be affected. Those seeking to do so should proceed with caution as the situation continues to evolve. We will keep our community informed with the most up-to-date information as it becomes available.

While this is an abhorrent moment in a year full of them, we are not unprepared. We are fighting back. We are standing together to protect one another. We are not alone—and we are not powerless.
